Suffolk Restaurant Week “Indulge Yourself 2010 Giveaway” Enter for a chance to win a Suffolk Restaurant Week "Indulge Yourself Giveaway" package for two that includes: one (1) night stay at the riverfront Hilton Garden Inn - Suffolk, a $100 gift certificate for a performance or classes at the Suffolk Center for Cultural Arts and a $100 gift certificate for dinner at River Stone Chophouse, all redeemable through May 31, 2011.

OFFICIAL RULES

NO PURCHASE NECESSARY: A purchase will not improve your chances of winning. Participation is limited to legal residents of the United States and the District of Columbia, who are 21 years of age or older as of the date of entry. Void outside the United States and where prohibited by law. All federal, state and local laws and regulations apply. This giveaway starts at 12:00 a.m. (midnight) on February 2, 2010, eastern standard time and ends at 12:00 a.m. (midnight) March 31, 2010, eastern standard time. All entries must be received no later than midnight (12:00 a.m.) eastern time on Wednesday, March 31, 2010, in accordance with the entry rules listed below. The Suffolk Restaurant Week Indulge Yourself Giveaway is governed by the laws of the Commonwealth of Virginia, U.S.A. Limit one entry per day per person/household. No individual may enter under more than one name, address or email address. Odds of winning depend on the number of eligible entries received.

PROMOTION DETAILS: The City of Suffolk’s Division of Tourism will randomly select one (1) entry on Thursday, April 1, 2010, or the next regular business day, whichever is earlier, from the eligible entries received with notification made to the winner the same day via telephone and/or email. The winner will have ten (10) days to claim the prize. Subject to compliance with the terms of these official rules (including execution of certain affidavits and releases as described below), the winning contestant will receive a Suffolk Restaurant Week "Indulge Yourself Giveaway" package for two that includes: one (1) night stay at the riverfront Hilton Garden Inn - Suffolk, a $100 gift certificate for a performance or classes at the Suffolk Center for Cultural Arts and a $100 gift certificate for dinner at River Stone Chophouse, all redeemable through May 31, 2011.

The winning contestant shall be notified and required to sign and return an affidavit of eligibility and a release of publicity/liability for winner and travel companion by the date specified in the affidavit or an alternate contestant may be selected by a second random drawing. Except for the specific prizes listed herein, the winning contestant shall be responsible for any and all other costs associated with participating in this promotion, including all travel, food, and lodging expenses associated with such participation. The City of Suffolk or any other entity participating in this promotion will not be responsible for any travel, food or lodging expenses for the winning participant beyond the prize package as a part of this promotion or otherwise. The prize is non- transferable, non-negotiable and not redeemable for cash, credit or merchandise. If any prize component becomes unavailable for any reason, the City of Suffolk reserves the right to substitute a component of comparable value. Entrants agree that the City of Suffolk has the sole right to decide all matters and disputes arising from this giveaway and that a decision by the City of Suffolk is final and binding. PRIZE: If selected as the winner of the Suffolk Restaurant "Indulge Yourself Giveaway" promotion, you will win a package for two that includes: one (1) night stay at the riverfront Hilton Garden Inn - Suffolk, a $100 gift certificate for a performance or classes at the Suffolk Center for Cultural Arts and a $100 gift certificate for dinner at River Stone Chophouse. Approximate Retail Value of the Prize is $400.

GENERAL EVENT RULES: The City of Suffolk shall have the right and authority to use winner's and travel companion’s name, image, likeness, and videotape footage in any promotional, publicity, or other public relations events as it deems appropriate, and winner shall not contest such use by the City of Suffolk. The winner must be available and participate in public relations events as reasonably requested by the City of Suffolk before, during and after prize redemption. A potential winner may be requested to provide the City of Suffolk with proof that the potential winner is the authorized account holder of the email address associated with the winning entry. If a dispute cannot be resolved, the entry will be deemed ineligible.

ELIGIBILITY: Participants must be legal residents of the United States who are at least 21 years or older as of the date of entry. Winner’s travel companion(s) must be one of the following: a) 21 years of age or older, or b) if travel companion is a minor and not a child or legal ward of the winner, then the winner must provide such minor’s parent or legal guardian’s notarized written permission and liability/publicity release prior to receiving the prize. Employees of the Released Parties or other individuals engaged in the development, production or distribution of promotion materials and persons who are immediate family (parents, children, siblings, stepparents, stepchildren, stepsiblings and spouse) or who reside in the same household as persons in the preceding categories are not eligible to enter or win.

CONDITIONS OF PARTICIPATION: By participating in the giveaway you accept and agree to these official rules, which are final and legally binding. Recipient is responsible for all applicable federal, state and local taxes on all prizes. By entering this promotion and/or accepting the prize, you (and/or your designee in the case of physical limitations) hereby agree to release, indemnify and hold harmless the City of Suffolk, the riverfront Hilton Garden Inn - Suffolk, the Suffolk Center for Cultural Arts and River Stone Chophouse and each of their respective parents, affiliates, and subsidiary companies, advertising and promotions agencies, and all of their respective employees, officers, shareholders, directors and agents, and other participating partners in the giveaway (collectively, "Released Parties") from (i) any and all liability, loss, harm, damage, cost or expense, including all reasonable counsel fees and court costs incurred, property damage, personal injury and/or death; (ii) anything related to the production, promotion or execution of this promotion (or your participation therein), including preemption, cancellation or rescheduling of any event or performance; (iii) that which may occur in connection with acceptance and/or use of the prize or while participating in or traveling to any promotion-related activity. Acceptance of prize constitutes permission for Released Parties and their designees to use winner's and travel companion’s names and/or likenesses, voices, pictures, and city and state of residences and any information provided on the entry (with the exception of physical address and phone number) for purposes of advertising and trade, publicity or promotion (except where prohibited) in any medium of communication, including print, Internet, radio and/or television, without additional compensation, unless prohibited by law. Entrants are disqualified at any time for failure to comply with the terms of these rules or the instructions by the City of Suffolk.

ADDITIONAL DISCLAIMERS: The Released Parties and each of their agencies and partners are not responsible for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/website use/net accessibility, availability or traffic congestions, or any technical error, or unauthorized human intervention, or the incorrect or inaccurate capture of giveaway entry or other information, or the failure to capture any such information. The Released Parties and each of their agencies and partners are not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking or by any of the equipment or programming associated with or utilized in the promotion and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the websites related to the promotion. Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at City of Suffolk’s servers or elsewhere, will not be eligible. The Released Parties reserve the right, at their sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the promotion or any website related to the promotion, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry methods will void all such methods, and disqualify any participant using such methods. The Released Parties and each of their agencies and partners are not responsible for injury or damage to participants or to any other person’s computer related to or resulting from participating in this promotion or downloading materials from or use of any website related to the promotion. If, for any reason, the promotion is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which the City of Suffolk in its sole opinion deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the City of Suffolk reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion. In the event of a dispute regarding on-line entry, the entry will be deemed to be submitted by the authorized holder of the e-mail account submitted at the time of entry. Authorized account holder is defined as the natural person who is assigned an e-mail address by the Internet access provider, on-line service provider or other organization that is responsible for arranging e-mail address for the domain associated with the submitted e-mail address. Rules are subject to any requirements/limitations imposed by the Federal Communications Commission.

Winner and travel companions agree that the City of Suffolk, the riverfront Hilton Garden Inn- Suffolk, the Suffolk Center for Cultural Arts, River Stone Chophouse, other participating partners and sponsors, and all of their respective employees, officers, shareholders, directors and agents, subsidiaries, affiliates, agents, shall not be liable for injuries or losses of any kind resulting from acceptance of or use of prizes. All traveling companions of the winner, and the parents and legal guardians of any minor traveling companions, by accepting any of the benefits of the prizes awarded, shall have agreed to be bound by the provisions of this disclaimer. All Federal, State, and local laws and regulations apply. Giveaway rules shall be governed and enforced pursuant to the laws of the Commonwealth of Virginia.
